Terms of Service
Last updated: 7 October 2026
These terms govern your use of estype: the website at estype.com, the workspace app at app.estype.com and your workspace's own address, the API, the command line tool (CLI) and the MCP server. Please read them before you subscribe. By starting a trial, completing an order or using the service, you accept them.
1. About these terms
estype is provided by ELIM GROUP LLC. In these terms "we", "us", "our" and "estype" mean ELIM GROUP LLC, and "you" and "your" mean the person or organisation that holds the subscription. If you accept these terms for a company or other organisation, you confirm that you have authority to bind it, and "you" means that organisation.
Your agreement with us is made up of:
- these Terms of Service;
- our Refund Policy;
- our Data Processing Addendum (DPA), which applies whenever we process personal data on your behalf; and
- any written order or agreement we sign with you for a plan sold by agreement (an "Order").
If these documents conflict, the Order applies first, then the DPA (only on how personal data is processed), then these terms, then the Refund Policy. How we handle personal data as a controller, for example your account details, is described in our Privacy Policy, which is not part of this agreement.
Your payment is made to Paddle.com, not to us, under Paddle's own terms (see section 6).
2. Definitions
- Service: estype as we make it available to you, including the workspace app, the API, the CLI, the MCP server, the software development kits and the documentation.
- Workspace: the separate space, with its own database and its own address
(
name.app.estype.com), that we create for a subscription. - Users: the people you allow into your workspace, and the API keys and agents you create for it.
- Customer Data: everything you or your users put into the service or pull into it from other systems: content, schemas, files, form submissions, records copied from connected services, dashboards and the credentials you give us for those services.
- Usage Data: information about how the service runs and is used, such as request counts, error rates, the number of records moved and feature use. It does not include the contents of Customer Data.
- Plan: the subscription tier you buy, with the modules, limits and allowances described on our pricing page or in your Order.
- Subscription term: the billing period you have paid for (monthly or annual), and each renewal of it.
3. Accounts, workspaces and users
3.1 Who may subscribe
The service is made for businesses and professionals. You must be at least 18 years old and able to enter into a binding contract. Information you give us when you sign up or subscribe, including your name and email address, must be accurate, and you must keep it up to date.
3.2 Your workspace
Each trial and each subscription has one workspace and one owner. The owner controls the workspace, invites users, gives them roles (owner, editor, viewer or restricted share) and creates API keys. You choose the workspace name when you sign up; it becomes part of the workspace's address and cannot be a name that is already in use or reserved.
3.3 Your users and credentials
You are responsible for:
- everything done in your workspace by your users, by your API keys and by any agent or program acting with them, as if you had done it yourself;
- making sure your users follow these terms;
- keeping passwords and API keys secret, giving each key only the access it needs, and rotating or revoking a key you think has been exposed; and
- telling us without delay at security@estype.com if you suspect someone has used your workspace or credentials without permission.
You may let your employees, contractors and clients use your workspace for your business. You may not resell access to the service or share one subscription between unrelated organisations, unless an Order allows it.
4. What the service is, and what it is not
estype is a hosted data platform. In one workspace it provides a headless content management system with a delivery API, forms and lead handling, connectors that copy records between the service and other systems you use, dashboards over those records, and a CLI and MCP server to operate all of it. The modules and limits available to you depend on your plan. The documentation describes how each part works.
Some limits are part of how the service works, not faults in it:
- We read and write other systems through their own APIs. If one of them is down, changes its API, revokes a credential or limits our requests, its data does not arrive or leave until it works again.
- Connectors run on a schedule. A record copied from another system is as recent as the last successful run, which the workspace shows.
- Figures and reports in the service are calculated from the data you connect. The service is not an accounting system or a book of record for tax, and nothing it shows is financial, legal or tax advice.
- The service contains no AI model. It does not generate content or make decisions for you.
How we protect the service and your data is described on our Security page. That page describes our current practice; it is not a separate promise beyond these terms and the DPA.
5. Plans, trials and renewal
5.1 Plans
We offer self-serve plans that you buy online, monthly or annually, and plans sold by agreement under an Order. The current plans, what each includes and their prices are on our pricing page and in the checkout.
5.2 Free trial
Self-serve plans start with a 7-day free trial. No payment details are needed to start it. When it ends, the workspace becomes read-only, with your data kept, until you choose a plan and pay in the workspace's Billing page; nothing is charged until you do. One trial per customer: we may refuse a trial to someone who has already had one.
5.3 Automatic renewal
A subscription renews automatically for the same billing period, at the price that applies on the renewal date, until it is cancelled. Paddle sends renewal reminders where the law requires them.
5.4 Allowances and usage beyond them
Plans include allowances, such as the number of records moved in a month, documents, storage and connected sources. If your plan provides for charges for use beyond an allowance, those charges and any cap on them are shown on the pricing page and in the checkout before you buy, and are billed through Paddle. Where a plan has no such charges, we may ask you to move to a larger plan if your use stays above its limits.
5.5 Changing plans
You can move to another plan at any time. Paddle calculates any amount due or credit for the change and shows it before you confirm. When you move to a smaller plan, data or settings that the smaller plan does not support may stop working; we do not delete them because of the change alone.
6. Orders, payment and the Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Paddle sells the subscription to you and we supply the service. Your purchase is therefore also subject to the Paddle Buyer Terms and the Paddle Refund Policy, and Paddle handles your payment details under its Privacy Notice.
- Price and tax. Before you pay, the checkout shows the plan, the billing period, the currency and the total, including any tax. Nothing is charged until you confirm it. Paddle charges and accounts for sales tax and VAT, and issues the invoice or receipt.
- Payment. Paddle takes payment by the methods its checkout offers. We never take payment from you directly and never see or store your card details.
- Failed payments. If a renewal payment fails, Paddle may try again. The workspace keeps working for 7 days after a payment fails; if the payment is still outstanding after that, we may suspend the workspace until it is paid (see section 14).
- Price changes. We may change our prices. A new price applies to your subscription only from a renewal date, and you are told before it applies. If you do not accept it, you can cancel before the renewal.
- Plans sold by agreement. An Order may set its own prices, billing period, payment method and term. Where it does, the Order applies to those points.
You can reach Paddle about any order, receipt, invoice, cancellation or refund at paddle.net.
7. Correcting a mistake in an order
You can review and change the plan, the billing period, the country and the total in the checkout before you confirm. If you notice a mistake after paying, such as the wrong plan, the wrong billing period or a duplicate order, write to legal@estype.com and we will ask Paddle to correct or refund it. You do not have to keep a subscription you bought by mistake.
8. Cancelling and refunds
You can cancel a subscription at any time, by any of these routes:
- the Manage subscription link in the confirmation email Paddle sent you, which opens the Paddle customer portal, then Cancel subscription;
- paddle.net, which finds your purchases from the email address you used;
- the billing screen in your workspace, which links to the Paddle customer portal; or
- by writing to legal@estype.com and asking us to do it.
Cancellation takes effect at the end of the billing period you have already paid for. The service keeps working until then and you are not charged again. Refunds, including our 14-day refund on the first payment for a plan, are covered by our Refund Policy. What happens to your data afterwards is in section 16.
Completing the checkout means you have read and accept these terms and the Refund Policy. If you do not accept them, do not complete the order.
9. Your data
9.1 You own Customer Data
Customer Data belongs to you or to whoever you received it from. These terms do not give us any ownership of it.
9.2 What we may do with it
You allow us to host, store, copy, transmit, process and display Customer Data only as needed to provide the service to you, to keep it secure, to give you support you ask for, and to comply with the law. In particular, we do not:
- sell Customer Data or use it for advertising;
- use Customer Data to train AI models, or send it to AI providers;
- look at the contents of your workspace except to provide support you ask for, to investigate a security incident or abuse, or where the law requires it.
9.3 Personal data
When Customer Data includes personal data, you are the controller and we process it on your behalf under our Data Processing Addendum, which forms part of this agreement. The providers we use to run the service are listed on our Subprocessors page.
9.4 Your responsibilities
You are responsible for Customer Data: that you have the right to put it into the service and to connect the systems it comes from, that it is lawful, and that you have given any notices and obtained any consents the law requires, including from people whose data your forms collect.
9.5 Usage Data
We use Usage Data to run, secure, bill, support and improve the service, for example to count records against your allowance or to find the cause of an error. We may publish statistics built from Usage Data only if they do not identify you, your users or any individual.
9.6 Backups
We keep backups of the service as described on our Security page, so that we can recover from a failure. They are not a substitute for your own copies: you can export your content and records at any time, and you should keep copies of anything you cannot afford to lose.
10. Acceptable use
You must not, and must not allow anyone else to:
- use the service in a way that breaks the law or infringes anyone's rights, including their intellectual property, privacy or data protection rights;
- store, publish or send through the service content that is unlawful, defamatory, abusive, sexually exploits anyone, or promotes violence;
- send spam or unsolicited messages through the service, or use its forms to collect data under false pretences, for example to imitate another organisation's login page;
- upload or distribute malware, or use the service to attack, probe or disrupt any system, including ours and those you connect;
- try to reach parts of the service, other workspaces or data that are not made available to you, or get around authentication, rate limits or other security or usage controls;
- test the security of the service except under our responsible disclosure policy;
- put load on the service that is far beyond normal use of your plan, or that harms other customers' use of it;
- copy, modify or create works based on the service, or decompile, reverse engineer or try to extract its source code, except where the law allows this and cannot be excluded;
- resell, rent or sublicense the service, or use it to build a competing product;
- remove or change our notices, names or logos in the service; or
- use the service where it is prohibited by sanctions or export laws, or on behalf of a person who is subject to sanctions.
If we become aware of a breach of this section, we may remove the content concerned or limit access to it, and we may suspend the workspace under section 14.
11. The API, the CLI, MCP and AI agents
- Access. You may use the API, the CLI, the MCP server and our software development kits to work with your own workspace, and to build sites, apps and tools for your business and your clients that use it.
- API keys. An API key is shown once and stored by us only in a form that cannot be turned back into the key. Anyone holding a key can do whatever that key allows, so treat keys like passwords. Keys meant for publishing content can be placed in a public website; other keys must stay private.
- Rate limits. Requests are subject to rate limits and to your plan's limits. We may change rate limits to protect the service; we will not reduce them in a way that stops normal use of your plan without telling you first.
- AI agents. You may connect your own AI agents and tools to your workspace through the CLI or MCP. They act with the credentials you give them, under your control. You are responsible for what they do, including changes they make to your data or to connected systems, as if a user had done it. Every content change is recorded with who made it and can be restored, but you should give an agent only the access it needs.
- Changes. We may change the API, the CLI and the MCP server. When a change would break a documented interface you use, we will give reasonable notice where we can, unless the change is needed for security or by law.
12. Third-party services you connect
The service can connect to systems run by other companies, such as content tools, website builders, banks, task trackers and recruiting systems. When you connect one:
- your use of that system is governed by your own agreement with its provider, and that provider is not our subprocessor;
- you allow us to read and write data in it as you configure, using the credentials you give us, which we store encrypted;
- we are not responsible for that system, its availability, its data or changes it makes to its API, and a connector may stop working if the provider changes or withdraws its API.
13. Availability, support and changes to the service
13.1 Availability
We work to keep the service running and to restore it quickly when it fails. We monitor it from outside and announce planned maintenance in advance where we can. Unless an Order says otherwise, we do not offer a service level agreement, uptime commitment or service credits.
13.2 Support
Support is by email at hi@estype.com. We answer in English, on business days. An Order may include other support terms.
13.3 Changes to the service
The service changes over time. We may add, change or remove features. If we remove a feature or module that is a material part of your plan, we will tell you at least 30 days before, unless that is not possible for reasons of security, law or a third party withdrawing a service, and if the change makes the service materially worse for you, you may cancel and receive a refund of the unused part of any prepaid period.
13.4 Beta features
Features we label as beta, preview or early access are offered as they are, may change or be withdrawn at any time and are not covered by any commitment in section 13.
14. Suspension
We may suspend all or part of your access to the service if:
- a payment is still outstanding 7 days after it failed;
- you or your users breach section 10 or section 11;
- your use creates a security risk, or a risk to the service or to other customers; or
- we are required to by law or by a court or public authority.
We will suspend only as much as is needed, tell you why, and, unless it is urgent or the law prevents it, give you a chance to fix the problem first. We restore access when the cause is resolved. Suspension does not delete Customer Data. If we suspend a workspace when you have done nothing wrong, we will refund the unused part of the period through Paddle.
15. Term and termination
15.1 Term
This agreement starts when you begin a trial, complete an order or sign an Order, and continues until your subscription ends.
15.2 Ending it yourself
You may end the agreement at any time by cancelling your subscription (see section 8). Cancellation takes effect at the end of the paid billing period. An Order may set a fixed term.
15.3 Ending it for breach
Either of us may end the agreement by notice if the other materially breaches it and does not put the breach right within 30 days of being told about it in writing. We may end it at once by notice if you seriously or repeatedly breach section 10, or if you become insolvent or stop doing business.
15.4 What happens when it ends
When the agreement ends, your right to use the service ends. Amounts already due stay due. If you end the agreement because of our uncured breach, or we end it for a reason that is not your fault, we will refund the unused part of any prepaid period through Paddle. Sections 9, 16 to 23 and 25 to 29 continue to apply after the agreement ends.
16. Your data when the subscription ends
- Before it ends. You can export your content, records and files at any time while your workspace is active, through the workspace app, the API or the CLI.
- After it ends. When the subscription ends or is refunded, the workspace stops answering requests, but we keep its data for 30 days. During that time you can resubscribe and carry on as before, or ask us at legal@estype.com for an export, which we provide in standard formats (such as JSON, CSV and the original files).
- Deletion. After those 30 days we delete the workspace and its data from the live service within the following 30 days, and we have no duty to keep it longer. You can ask us to delete it sooner. Copies in our backups are not restored for any other purpose and are erased as each backup expires, at the latest within 8 weeks. The DPA sets out how we delete personal data.
17. Our intellectual property
We and our licensors own the service, its software, design, documentation, names and logos, and all intellectual property in them. During your subscription we give you a limited, non-exclusive, non-transferable right to use the service for your business under these terms. We keep all rights not expressly given to you.
Some parts of the service, such as software development kits and starter code, may be published under an open source licence. Where they are, that licence governs your use of that code.
You own what you build with the service, such as your sites, apps and the content models you design, apart from our own parts that you use in them.
We will not name you as a customer, or use your name or logo, in public without your permission.
18. Feedback
If you send us ideas, suggestions or other feedback about the service, we may use them freely and without paying you. We will not identify you as their source without your permission.
19. Confidentiality
Each of us may receive non-public information from the other, such as Customer Data, the terms of an Order, security information or plans that the other marks as confidential or that a reasonable person would understand to be confidential. The one receiving it will:
- use it only to perform or receive the service under this agreement;
- share it only with its staff, contractors and advisers who need it for that purpose and are bound by similar duties of confidentiality; and
- protect it with at least reasonable care.
This does not cover information that is or becomes public through no fault of the receiver, that the receiver already had or developed on its own, or that it lawfully received from someone else without a duty of confidence. A party may disclose information when the law or a court requires it, after telling the other first where the law allows. These duties continue for 5 years after the agreement ends, and for as long as the information remains a trade secret or personal data.
20. Warranties and disclaimer
We promise that:
- we will provide the service with reasonable skill and care;
- the service will work in all material respects as its documentation describes; and
- we will not knowingly introduce malware into the service.
If we break one of these promises, tell us. We will fix the problem within a reasonable time, and if we cannot, you may end the agreement and receive a refund of the unused part of any prepaid period. For a business customer, this is your only remedy for a breach of these promises.
Each of us confirms that it has the authority to enter into this agreement.
Apart from what this section says, and to the extent the law allows, the service is provided "as is" and "as available". We give no other promise, express or implied, including that the service will be uninterrupted or error-free, that it is fit for a particular purpose, or that results calculated from your data are correct. We are not responsible for failures caused by the internet, by your own systems or by the third-party services you connect.
21. Limitation of liability
21.1 What is never limited
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law. Nothing in this section limits your duty to pay for the service or your obligations under section 22.
21.2 Losses neither of us is liable for
Subject to section 21.1, neither of us is liable to the other, whether in contract, tort (including negligence) or otherwise, for loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss.
21.3 The cap
Subject to section 21.1, each party's total liability arising out of or in connection with this agreement is limited to the fees you paid for the service in the 12 months before the event that gave rise to the claim.
21.4 Data
If Customer Data is lost or damaged because of our breach, our first obligation is to use reasonable efforts to restore it from our backups. Any further liability for it is subject to this section.
22. Indemnities
This section does not apply to consumers.
22.1 From you
You will defend us against, and pay the losses, damages and reasonable costs that result from, any claim by a third party arising from Customer Data, from your or your users' use of the service in breach of these terms or the law, or from actions taken by agents or programs acting with your credentials.
22.2 From us
We will defend you against any claim by a third party that the service, used as these terms allow, infringes that party's intellectual property rights, and pay the damages and reasonable costs a court awards or that we agree in a settlement. If such a claim is made or likely, we may change the service so that it no longer infringes, get you the right to keep using it, or, if neither is reasonably possible, end the agreement and refund the unused part of any prepaid period. We are not responsible for a claim caused by Customer Data, by a connected third-party service, by a change you made, or by use of the service with something we did not provide. This is your only remedy for such a claim, and it is subject to the cap in section 21.3.
22.3 How a claim is handled
The party asking for protection must tell the other promptly about the claim, let it control the defence and any settlement, and give reasonable help at the other's cost. A settlement that admits fault for, or places an obligation on, the protected party needs its consent, which it will not refuse without good reason.
23. If you are a consumer
The service is made for business use, but Paddle may sell it to someone buying as a consumer. If you are a consumer, you have rights under the law of the country where you live that these terms cannot take away, including rights to withdraw from the purchase within a set period and to a service provided with reasonable care and skill. Where these terms conflict with those rights, your rights apply. Our Refund Policy and the Paddle Refund Policy explain how to withdraw.
24. Changes to these terms
We may update these terms, for example to reflect a change in the law, in Paddle's requirements or in the service. The date at the top of this page shows when the current version took effect. If a change materially affects you, we will email the workspace owner at least 30 days before it applies, unless it is needed sooner by law or to deal with a security risk. If you do not accept the change, you may cancel before it applies and receive a refund of the unused part of any prepaid period. If you keep using the service after the change applies, the new terms apply to you. A change never applies to a dispute that arose before it. An Order can only be changed in writing signed by both of us.
25. Notices
We send notices to the email address of your workspace owner, or show them in the workspace app. You send legal notices to us at legal@estype.com. An email notice is treated as received on the next business day after it is sent, unless the sender is told it was not delivered. Please keep the owner's email address up to date.
26. Complaints
Write to legal@estype.com with "Complaint" in the subject. We acknowledge a complaint within 2 business days and give a full answer within 10 business days; if we need longer, we say so and give a date. You can also raise anything about a payment, an invoice or a refund with Paddle at paddle.net. Complaining to us does not affect your legal rights.
27. General
- Transfer. You may transfer this agreement only with our written consent. We may transfer it to a company in our group, or to a buyer of all or most of our business, and will tell you if we do. A transfer does not reduce your rights.
- Subcontractors. We may use subcontractors and service providers to provide the service. We remain responsible for their work under this agreement. Those that process Customer Data are listed on our Subprocessors page.
- Events outside our control. Neither of us is responsible for a delay or failure caused by events beyond its reasonable control, such as a failure of the internet or of a hosting provider, a natural disaster, war, an epidemic, a cyber attack we could not reasonably prevent, or an act of government. This does not excuse your duty to pay. If such an event stops the service for more than 30 days, either of us may end the agreement and you will receive a refund of the unused part of any prepaid period.
- Severability. If a court finds part of these terms unenforceable, that part is changed as little as needed to make it enforceable, and the rest stays in force.
- No waiver. If either of us delays in enforcing a right, that right is not lost.
- Entire agreement. The documents listed in section 1 are the whole agreement between us about the service and replace earlier discussions about it. Terms in your purchase orders, supplier portals or similar forms do not apply, even if we accept or sign them. Nothing here limits liability for fraud.
- Third parties. No one other than you and us has any right to enforce these terms, including under the Contracts (Rights of Third Parties) Act 1999.
- Independent parties. We are independent contractors. Nothing in this agreement creates a partnership, joint venture, agency or employment between us.
- Language. These terms are written in English. If we provide a translation and it differs, the English version applies, unless consumer law requires otherwise.
28. Governing law and courts
This agreement, and any dispute or claim arising out of or in connection with it, including non-contractual disputes or claims, is governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts of that country. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before going to court, please write to us at legal@estype.com so that we can try to settle the matter.
